TERMS AND CONDITIONS (of supply)
for Lore Wormsbächer - Nutrilore Dietitian

By booking an appointment with Lore Wormsbächer – Nutrilore Dietitian, you acknowledge that you have read, understood, and agreed to these terms and conditions.
Definitions
· References to “We”, ‘’Us’’ or “Our” shall be references to Lore Wormsbächer – Nutrilore Dietitian
· References to “You”, “Your”, ‘’Client’’ or “Service User” shall be references to the service user or client.
· References to “Terms” and “Agreement” mean the terms and conditions herein.
· References to “Appointments’’ or ‘’Bookings’’ means scheduled and confirmed appointments between Lore Wormsbächer – Nutrilore Dietitian and the service user or client.
· References to ‘’services’’ means the professional services provided and delivered by Lore Wormsbächer – Nutrilore Dietitian more particularly set out in the Booking Confirmation email and/or as agreed with you from time to time.
Introduction
· Welcome to Lore Wormsbächer – Nutrilore Dietitian, an online / virtual service providing appointments related to nutrition and health coaching. By booking a virtual (video call) or telephone appointment with us, you agree to abide by the following terms & conditions outlined in this agreement.
· If you do not agree with any part of these terms, you should not proceed with booking an appointment with us.
Services Offered
· Our agreement with you (Contract) includes these terms and conditions, as well as our Booking Confirmation email.
· A request for services via email or the “contact us” form on our website or via telephone does not mean your appointment is confirmed. This contract will only apply once appointments have been accepted and confirmed and you have received a Booking Confirmation email.
· Lore Wormsbächer – Nutrilore Dietitian provides virtual (video call) and telephone appointments and aims to provide professional dietary and nutrition advice related to diabetes management based on the information provided by you during the appointment as well as on the intake form completed by you before the appointment.
· These terms and conditions still apply if it has been agreed that you are accessing the Services via a promotion for “free services”, “unpaid services”, or “reduced service fee”.
· These terms and conditions apply regardless of how the services are delivered, e.g. via telephone call or video call or face-to-face / in-person appointment.
· All services are subject to availability, and we reserve the right to make any changes to services offered or the way that services are delivered. We will give you reasonable notice if any changes to services are made. You may have the right to cancel your contract with us if major changes are made.
· In certain circumstances, Lore Wormsbächer – Nutrilore Dietitian reserves the right to refuse to treat you, refuse a booking request or refuse to offer a particular service. We reserve the right to decline further services or subsequent appointments. If this is the case, we will refund any payments received for services not yet provided by us, but refunds will not be given for any services already provided.
· If the services you receive are as part of a “benefit” under a healthcare insurance scheme or health insurance company, your rights will also be subject to the rules and regulations of that scheme and your personal health insurance policy. Our terms and conditions will apply even when there are inconsistencies between the terms and conditions of your health insurance provider and our terms and conditions.
· We retain the authority to suspend services and end the contract if you fail to adhere to our suggestions or demands, neglect to make timely payments, or engage in behaviour that, from our reasonable perspective, contradicts the contract’s terms and associated responsibilities.
Medical Disclaimer
· Virtual or Telephone appointments with Lore Wormsbächer – Nutrilore Dietitian are not intended to be a substitute for professional medical advice, diagnosis, or treatment. It is crucial to consult with your primary healthcare provider before making any significant changes to your diet or nutritional management plan.
· Ensure you seek medical advice from your General Practitioner (GP) or another healthcare professional if this is recommended by Lore Wormsbächer – Nutrilore Dietitian.
· Always seek further medical advice if you have any concerns about the information given to you or if your condition or symptoms change.
· It is your responsibility to seek immediate medical advice if you suffer any adverse or unexpected effects to any dietary, exercise or lifestyle changes.
· We will clearly set out the Services we agree to provide to you via your Booking Confirmation email as well as on our website.
· We endeavour to provide the Services offered with reasonable skill and care, in accordance with our industry best practice and HCPC standards of care, as well as within a realistic timeframe.
· We cannot guarantee any results and/our outcomes from the use of our Services. We do not guarantee that you will achieve your desired health outcomes such as improvement of symptoms, however we aim to work with you to the best of our abilities to help you in improving your diabetes and nutrition related health goals.
Client and Service User Responsibilities
· By agreeing to these terms and conditions you agree to co-operate with us in all matters related to the Services. This includes providing relevant information to enable us to provide the agreed Services.
· All information provided by you must be true, complete, and accurate. You are responsible for making sure that all details are complete, accurate, and up to date. Failure to provide full or accurate information may impact on our ability to provide the services.
· Please contact us immediately if you think there is a mistake or changes need to be made to the information that you have provided, and we will attempt to accommodate the changes where possible.
· For us to be able to effectively fulfil the Services required, you agree to follow the requirements agreed with us before, during, and after your appointment.
· You agree to confirm with us that you understand completely the advice given by us and how to safely implement any recommendations or changes.
· Threatening, intimidating or inappropriate behaviour towards Lore Wormsbächer – Nutrilore Dietitian or any associated persons will not be tolerated. Such behaviour will be reported, and we have the right to terminate an appointment due to any behaviour we do not feel is appropriate and/or acceptable. You will not be refunded if an appointment is terminated on these grounds.
Booking, Prices and Payment Terms
· Appointments can be booked via Practice Better (Practice Management Software) booking system here.
· Payment is required at the time of booking an appointment and must be made through the available online electronic payment methods.
· Once the payment is successfully processed, you will receive a confirmation email with the appointment details.
· It is your responsibility to be aware of any applicable fees regarding our services and appointments.
· The price of services will be set out on our profile on Practice Better Practice Management Software website.
· We reserve the right to change prices and fees for services or appointments at any time, but these changes will not affect any bookings that have already been confirmed.
· Invoices will be provided, and VAT is not currently applicable to services unless otherwise stated on invoices or booking confirmation emails.
· If paying for a package with a set number of appointment, as agreed beforehand with Lore Wormsbächer – Nutrilore Dietitian, full payment of the total package must be made on booking the first appointment, unless an alternative fee schedule or payment plan has been agreed with us in advance.
· If payment has not received in advance of your scheduled appointment or booking, then your appointment or booking will be cancelled, and Lore Wormsbächer – Nutrilore Dietitian is not required to re-book this appointment.
· Any quotation or estimate of fees is valid for a maximum period of 14 days from its date unless we expressly withdraw it at an earlier time.
· Unless otherwise agreed, additional services provided will be charged at an hourly rate of £125.00. This only includes additional services that were not determined in the Booking Confirmation email.
Appointment Cancellation Fees and Rescheduling
· You have the right to cancel or reschedule your appointment, subject to the following terms.
· If you need to cancel or reschedule your appointment, please do so at least 24 hours before the scheduled time by contacting us via email at info@nutrilore.co.uk or via the Practice Better Practice Management Software Booking Service.
· Failure to provide at least 24 hours’ notice will result in cancellation fees to apply. This means that 100% of the appointment fee will be charged.
· If you change an appointment and this results in a change of price or fee, we will notify you of the changes as soon as possible before your appointment.
· If you fail to attend an appointment without giving any notice of cancellation, the full appointment fee will be charged, and no refunds will be provided.
· If you are late for an appointment, we will continue with the appointment only if this is appropriate, depending on the time left to carry out the appointment. The original finish time will however still apply. We will not carry out the appointment if we decide that it is not possible to carry out the appointment in the remaining time available. We will not be held responsible to re-book appointments for clients who attended too late or have failed to attend for any reason without providing adequate notice of cancellation (i.e. at least 24 hours prior to appointment start time).
· You do not need to give a reason for cancelling your appointment as long as this is done at least 24 hours in advance. Full refunds will be paid if appointments are cancelled within cancellation notice period (24 hours), unless these appointments are part of a package that was bought; in these cases the appointment will be rebooked, not refunded. We will not refund any appointments that have already been attended.
· Lore Wormsbächer – Nutrilore Dietitian reserves the right to cancel or reschedule appointments due to unforeseen circumstances. We will endeavour to provide as much notice as possible, however this may not always be possible. In such cases, we will offer a full refund or alternative appointment time.
· Should a client or service user request to terminate an appointment early, e.g. part-way through the delivery of the services or appointment, then payment will not be refunded for the appointment unless we otherwise determine at our reasonable discretion.

Confidentiality
· Lore Wormsbächer – Nutrilore Dietitian acknowledges that all information provided by you during the virtual or telephone appointment is private and confidential.
· We will not disclose any personal or medical information to third parties without your explicit consent, except where required by law to do so.
· As per the Data Protection Act 2018 we will comply with our obligations in the performance of our services and the GDPR. Please see our Privacy Policy for more details.
Copyright and Intellectual Property
· All materials, included but not limited to documents, handouts, and resources provided before, during, or after the appointment, are the property of Lore Wormsbächer – Nutrilore Dietitian and are protected by copyright laws.
· You agree to not reproduce, distribute, or modify any of the materials provided without our prior written consent.
Limitation and Liability
· Lore Wormsbächer – Nutrilore Dietitian and its dietitians or associates shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from or in any way connected with the virtual or telephone appointments provided.
· Under no circumstances will our liability exceed the payment made for the appointment.
· Lore Wormsbächer is a Registered Dietitian with the Health and Care Professions Council (HCPC) UK, registration number DT30387, and will therefore practice in accordance with HCPC standards of proficiency. · Lore Wormsbächer Dietitian is a registered member of the British Dietetic Association (BDA), registration number 21191, and is therefore obligated to have a Professional Indemnity arrangement (dietetics) in place as a condition of registration with the HCPC. The BDA provides Professional Indemnity insurance to all of its members.
Complaints
· These terms and conditions do not affect your legal rights in relation to services not carried out with reasonable skill and care.
· Please contact us as soon as possible to resolve any complaints or concerns by emailing us at info@nutrilore.co.uk

· If you find that services provided do not correspond with what we have agreed to provide, we may consider a refund or price reduction.
Other Important Information
· No other individuals possess rights within this agreement. This agreement pertains solely to you and us. No third party shall be granted the ability to enforce any of its clauses. Any transfer of your rights to another party necessitates our explicit consent, and any such transfer of rights or obligations from the Contract can only occur with our written agreement.
· Due to unforeseeable events beyond our control, the execution of some or all aspects of the Contract with you might be hindered; this is referred to as “Force Majeure”. These circumstances could encompass events like fires, riots, floods, natural disasters, epidemics, pandemics, government mandates or limitations, utility failures, onboard vehicle system breakdowns, strikes, or lockouts. In such scenarios, we might be able to terminate the contract without incurring any liability.
· Should any part of the Contract be deemed unlawful by a court, the remainder will remain binding. Each section of these terms functions autonomously. If any court or authoritative body deems and of the illegal, the other sections will remain fully valid.
· Our failure to promptly request your compliance with any obligations stipulated by these terms, or our delay in pursuing action against you for breaching the contract, does not relinquish your responsibility to fulfil those obligations. Nor does it preclude us from taking action against you at a later time. For instance, if you miss a payment and we do not immediately pursue it, but we continue providing the products, we can still require you to make the payment in the future.
· These terms are subject to the applicable laws and jurisdiction of England, and if you are a consumer, you can initiate legal proceedings concerning the products in U.K. courts.
Amendments
· Lore Wormsbächer – Nutrilore Dietitian reserves the right to modify or amend these terms and conditions at any time. Any changes will be effective immediately upon posting the updated version on our website and the Practice Better Practice Management Software, or by notifying you directly.
· It is your responsibility to review these terms and conditions periodically to stay informed of any updates.
By booking an appointment with Lore Wormsbächer – Nutrilore Dietitian, you acknowledge that you have read, understood, and agreed to these terms and conditions (electronically).
